What is a lasting power of attorney?
A lasting power of attorney (LPA) is a legal document that allows a person to appoint someone they know and trust to make decisions on their behalf , should they become unable to do so in the future. This person is referred to as an attorney.
Why should I have one?
The most significant reason a person may wish to make a LPA is control. A LPA enables a person to plan how their health, wellbeing and financial affairs will be looked after when they lose the capacity to make these decisions themselves. It allows them to choose:
The decisions they want to be made on their behalf.
The people they want to make these decisions.
How they want those people to make these decisions.
What happens if an LPA is not in place?
If a person does not have an LPA in place and subsequently become unable to deal with their own affairs, then a relative or other appropriate representative would need to make an application to the Court of Protection to be appointed as a deputy. This can be a long and expensive process and means the person lacking capacity will have no control over who is appointed to make decisions on their behalf or what decisions they can or cannot make.
